Terms of Service

1. Introduction

Welcome to doublestint.gg — iRacing Endurance Manager ("the Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our web application, which provides race coordination, telemetry analysis, and team management tools for iRacing endurance racing.

The Service is operated by Kyle Durnford, located in Edmonton, Alberta, Canada.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility and Account Requirements

2.1 Age Requirement

You must be at least 13 years of age to use this Service. By creating an account, you represent and warrant that you are at least 13 years old. This age requirement aligns with iRacing's minimum age requirement for their service.

2.2 iRacing Account Required

Use of this Service requires an active iRacing account. You must have valid iRacing credentials to authenticate and use the Service. We are not affiliated with iRacing.com Motorsport Simulations, LLC, and cannot create, modify, or support iRacing accounts.

2.3 Account Creation

To access certain features of the Service, you must create an account by providing:

  • A valid email address
  • Your iRacing ID (obtained through OAuth authentication)
  • Optionally, your Discord ID for team coordination features

You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

2.4 Account Sharing Prohibited

You may not share your account credentials with any other person. Each user must maintain their own individual account. Accounts found to be shared may be suspended or terminated without notice.

2.5 Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service or other users
  • Extended periods of inactivity (12+ months)
  • Non-payment of subscription fees (for Pro accounts)

You may terminate your account at any time through your account settings or by contacting support@doublestint.gg.

3. Service Description

3.1 Overview

doublestint.gg provides the following features:

  • Team management and coordination tools
  • Race scheduling and driver availability tracking
  • Real-time telemetry display during races
  • Lap time analysis and performance tracking
  • Fuel calculation and pit strategy tools
  • Car setup file storage and sharing
  • Practice session logging

3.2 Service Tiers

Free Tier:

  • Access to one active race at a time
  • Basic team coordination features
  • Historical race data retention
  • Community support

Pro Tier ($4.99 per team per month):

  • Unlimited active races per team
  • Advanced telemetry features
  • Priority support
  • Extended data retention
  • Volume discounts available for multiple teams:
    • 2 teams: 5% discount
    • 3 teams: 10% discount
    • 4 teams: 15% discount
    • 5+ teams: 20% discount

3.3 Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Factors beyond our control (hosting provider issues, internet connectivity, iRacing API availability)

We are not liable for any damages or losses resulting from Service unavailability.

3.4 Beta Features

Some features may be labeled as "beta" or "experimental." These features:

  • Are provided on an "as-is" basis
  • May be modified or discontinued without notice
  • May contain bugs or operate unreliably
  • Are not covered by any service level guarantees

4. iRacing Integration

4.1 Third-Party Service

This Service integrates with iRacing.com Motorsport Simulations, LLC's API and SDK. We are an independent third-party application and are not affiliated with, endorsed by, or sponsored by iRacing.

4.2 iRacing Terms

Your use of iRacing data through our Service is subject to iRacing's Terms of Service and Privacy Policy. You are responsible for compliance with iRacing's terms.

4.3 OAuth Authentication

We use OAuth 2.0 to authenticate your iRacing account. By connecting your iRacing account:

  • You authorize us to access your iRacing data as permitted by their API
  • You acknowledge that we do not have access to your iRacing password
  • You can revoke our access at any time through iRacing's account settings

4.4 Data Accuracy

We retrieve telemetry and race data from the iRacing SDK and API. While we strive for accuracy:

  • We cannot guarantee the accuracy, completeness, or timeliness of iRacing-provided data
  • Discrepancies between our Service and iRacing's official data may occur
  • We are not responsible for errors or omissions in iRacing-provided data

4.5 iRacing Service Interruptions

If iRacing's API or SDK becomes unavailable, certain features of our Service may not function. We are not liable for Service disruptions caused by iRacing's systems.

5. User Content and Conduct

5.1 User-Generated Content

You may upload certain content to the Service, including:

  • Car setup files (.sto format)
  • Race notes and comments
  • Driver availability schedules
  • Team information

5.2 Content Ownership

You retain all ownership rights to content you upload. By uploading content, you grant us a limited, non-exclusive, worldwide license to:

  • Store and display your content within the Service
  • Share your content with your designated team members
  • Process your content to provide Service features

This license terminates when you delete the content or terminate your account, except where retention is necessary for:

  • Legal compliance
  • Dispute resolution
  • Enforcement of these Terms

5.3 Content Restrictions

You agree not to upload, post, or transmit content that:

  • Violates any law or regulation
  • Infringes intellectual property rights
  • Contains malicious code or viruses
  • Is harassing, abusive, or threatening
  • Contains personal information of others without consent
  • Is spam or unsolicited advertising

5.4 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without notice.

5.5 Prohibited Conduct

You agree not to:

  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service's operation
  • Use automated systems (bots, scrapers) without authorization
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for any illegal purpose
  • Impersonate another person or entity
  • Collect personal information of other users
  • Abuse, harass, or threaten other users

5.6 Consequences of Violations

Violations of these Terms may result in:

  • Content removal
  • Account suspension or termination
  • Legal action if warranted
  • Reporting to appropriate authorities for illegal activity

6. Payment Terms

6.1 Subscription Fees

Pro tier subscriptions are billed monthly at $4.99 per team. Volume discounts apply automatically when you subscribe to multiple teams.

6.2 Payment Processing

Payments are processed through Stripe, Inc. By providing payment information, you:

  • Authorize Stripe to charge your payment method
  • Represent that you have authorization to use the payment method
  • Agree to Stripe's Terms of Service and Privacy Policy

We do not store your complete credit card information. Stripe handles all payment processing and security.

6.3 Billing Cycle

  • Subscriptions are billed monthly on the date you first subscribed
  • You will be charged automatically each billing cycle
  • Billing continues until you cancel your subscription

6.4 Price Changes

We may change subscription prices with 30 days' advance notice. Price changes will:

  • Be announced via email and in-app notification
  • Take effect at your next billing cycle after the notice period
  • Give you the opportunity to cancel before the new price applies

6.5 Taxes

Prices do not include applicable taxes. You are responsible for all sales, use, GST, HST, and other taxes. We will collect and remit taxes where required by law.

6.6 Cancellation

You may cancel your Pro subscription at any time through your account settings. Upon cancellation:

  • You will retain Pro access until the end of your current billing period
  • You will not be charged for subsequent billing periods
  • Your account will revert to the Free tier
  • Your data will be retained according to our data retention policy

6.7 Refund Policy

Refunds are considered on a case-by-case basis within 14 days of purchase. To request a refund:

  • Contact support@doublestint.gg
  • Provide your account email and reason for the refund request
  • We will review and respond within 5 business days

Refunds are generally granted for:

  • Technical issues preventing Service use
  • Duplicate charges or billing errors
  • Subscriptions purchased in error

Refunds are generally not granted for:

  • Change of mind after 14 days
  • Accounts in violation of these Terms
  • Partial month usage

6.8 Free Tier Limitations

Free tier accounts are subject to limitations including:

  • One active race at a time
  • Past races moved to historical archive
  • Historical data may be deleted after 12 months of inactivity

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, code, graphics, logos, and content (excluding user-generated content), is owned by Kyle Durnford and protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. This license does not include:

  • Copying or modifying the Service's code
  • Creating derivative works
  • Distributing or reselling the Service
  • Removing copyright or proprietary notices

7.3 Trademarks

"iRacing" and related trademarks are owned by iRacing.com Motorsport Simulations, LLC. Use of iRacing trademarks in this Service is for descriptive purposes only and does not imply endorsement or affiliation.

7.4 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without compensation or attribution.

8. Privacy and Data Protection

8.1 Privacy Policy

Our collection, use, and protection of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Data Security

We implement reasonable security measures to protect your data, including:

  • Encryption of data in transit (HTTPS/TLS)
  • Encryption of sensitive data at rest
  • Regular security updates and patches
  • Access controls and authentication

However, no system is completely secure. We cannot guarantee absolute security of your data.

8.3 Data Retention

Upon account deletion:

  • Your personal identifiers (email, iRacing ID, Discord ID) will be deleted within 30 days
  • Anonymized race statistics may be retained for historical and analytical purposes
  • Setup files you uploaded will be deleted
  • Team associations will be removed

9. Disclaimers and Limitations of Liability

9.1 "AS-IS" Basis

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, reliability, or completeness
  • Warranties of uninterrupted or error-free operation
  • Warranties of security or data integrity

9.2 Race Coordination

This Service is a coordination and analysis tool. We are not responsible for:

  • Missed driver changes or race schedules
  • Incorrect telemetry data or strategy calculations
  • Race outcomes or performance
  • Disputes between team members
  • iRacing penalties or protests

9.3 Third-Party Services

The Service integrates with third-party services (iRacing, Stripe, AWS). We are not responsible for:

  • Third-party service availability or reliability
  • Third-party terms, policies, or practices
  • Data provided by third-party APIs
  • Third-party security breaches

9.4 User Responsibility

You are solely responsible for:

  • Your use of the Service and any decisions based on Service data
  • Your racing performance and in-game conduct
  • Your relationships and agreements with team members
  • Backup of any critical data or setup files

9.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYLE DURNFORD AND THE SERVICE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Cost of procurement of substitute services
  • Any damages arising from use or inability to use the Service
  • Any damages arising from third-party services or content
  • Any damages arising from unauthorized access to your account

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

9.6 Jurisdictional Limitations

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In such jurisdictions, the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kyle Durnford, the Service, and our affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your user-generated content
  • Your conduct in connection with the Service

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

11.2 Jurisdiction

You agree that any dispute arising from these Terms or the Service shall be resolved in the courts of Alberta, Canada. You consent to the personal jurisdiction of such courts.

11.3 Informal Resolution

Before filing a legal claim, you agree to contact us at support@doublestint.gg to attempt informal resolution. We will attempt to resolve disputes in good faith.

11.4 Time Limitation

Any claim or cause of action arising from these Terms or the Service must be filed within one (1) year after the claim arose, or it will be permanently barred.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements or understandings.

12.2 Modifications to Terms

We may modify these Terms at any time by:

  • Posting the updated Terms on the Service
  • Sending email notification to your registered email address
  • Displaying a notice in the Service

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.

Material changes (such as changes to payment terms or privacy practices) will be announced at least 30 days before taking effect.

12.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver will be effective unless made in writing.

12.4 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

12.5 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms or our rights and obligations to any party without restriction.

12.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

  • Acts of God (natural disasters, pandemics)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet or telecommunications failures
  • Third-party service provider failures

12.7 Survival

Provisions that by their nature should survive termination of these Terms will survive, including: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.

12.8 Notices

Notices to you may be sent to your registered email address or posted on the Service. Notices to us should be sent to:

12.9 Language

These Terms are provided in English. Any translations are provided for convenience only. In case of conflict between versions, the English version controls.

12.10 Independent Relationship

You and the Service are independent parties. These Terms do not create any partnership, joint venture, employment, or agency relationship.

12.11 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as explicitly stated.
